- No Financial Advice: My Crypto Merchant does not offer any financial advice of any kind. Our services are solely limited to providing the tools necessary to accept payments in various cryptocurrencies. My Crypto Merchant does not engage in any financial planning, investment, or advisory services. Any decision to accept cryptocurrency payments or engage in any cryptocurrency-related activity is solely your responsibility.
- No Liability for Loss of Cryptocurrency or Fiat Currency: By using My Crypto Merchant’s services, you expressly acknowledge and agree that My Crypto Merchant, its affiliates, directors, employees, and agents shall not be liable for any loss of cryptocurrency or fiat currency resulting from the use of our services. This includes, but is not limited to, any loss resulting from unauthorized access to your account, errors in processing, or fluctuations in the value of cryptocurrencies.
- No Processing, Handling, or Holding of Customer Funds: My Crypto Merchant does not process, handle, or hold any customer funds. Our services facilitate the direct transfer of cryptocurrency payments from customers to your designated cryptocurrency account. We do not act as an intermediary or custodian for any customer funds.
- Indemnification: You agree to indemnify, defend, and hold harmless My Crypto Merchant, its affiliates, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or in connection with your use of our services, your violation of these Terms of Use and Disclaimer Policy, or any third-party rights, including but not limited to intellectual property rights.
- Disclaimer of Warranties: My Crypto Merchant provides its services on an “as is” and “as available” basis. We expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- Limitation of Liability: In no event shall My Crypto Merchant, its affiliates, directors, employees, or agents be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses (even if My Crypto Merchant has been advised of the possibility of such damages) resulting from the use or inability to use our services.
- Governing Law and Jurisdiction: These Terms of Use and Disclaimer Policy shall be governed by and construed in accordance with the laws of the State of Oregon. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of that jurisdiction.
- Banned or Reserved Names: My Crypto Merchant reserves the right to decline to register any Account name for any reason whatsoever including the following for your reference, vulgar, hateful, racist or demeaning words, trademarked names and other common use words that are considered inappropriate by the company. Some names may be available at a premium at the company’s discretion. Our decisions are final and binding under the terms of this agreement. If we decline to register a name you request you will receive an explanation of our decision and a full refund of your initial set up fee.
- Changes to Terms of Use and Disclaimer Policy: My Crypto Merchant reserves the right to modify or update these Terms of Use and Disclaimer Policy at any time without prior notice. Your continued use of our services constitutes your acceptance of any changes to these terms. It is your responsibility to review these terms periodically to stay informed of any updates or changes.
